Terms of Service
Last updated October 7, 2026
These Terms of Service (“Terms”) govern your access to and use of NextShot (the “Service”), operated by NextShot (“NextShot,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you’re agreeing on behalf of a company or team, you’re confirming you have the authority to bind that organization.
1. What NextShot is
NextShot is an account outreach workspace for B2B sales teams: it researches target accounts, drafts personalized outreach messaging, scores it, and keeps the resulting activity, replies, and deal history in one place. Some features use third-party AI models (currently Anthropic’s Claude) to generate research and drafted messages on your behalf.
2. Accounts
You need an account to use NextShot. You’re responsible for the accuracy of the information you provide and for activity that happens under your account. Notify us promptly if you believe your account has been compromised.
Each seat is for one named person. Don’t share a login or let more people use NextShot than you have seats for. When someone leaves, the owner can remove them and give the seat to someone else. We may ask you to add seats, or limit access, if we see one login being used by several people.
A team has one owner, who holds the subscription and is responsible for paying for it, and may have admins. The owner and admins control who joins the team, can remove people, manage the team’s shared settings, and may have visibility into workspace activity and generated content associated with the team. Teammates’ access depends on the owner’s subscription. If ownership is transferred, the subscription and its billing move to the new owner.
3. Your data and content
You retain ownership of the data you put into NextShot, account and contact records, notes, uploaded lists, and anything else you enter (“Customer Data”). You grant us a license to use Customer Data solely to operate, maintain, and improve the Service for you, including sending relevant portions of it to our AI providers to generate research and drafts on your behalf.
We do not sell Customer Data, and we do not use it to train third-party AI models, see our Privacy Policy for how your data is processed and shared with the services NextShot relies on.
4. AI-generated content
NextShot uses AI to draft research summaries, outreach strategy, and messages. AI output can be inaccurate, incomplete, or unsuitable for a given recipient. You’re responsible for reviewing any AI-generated content before sending it, treat it as a draft written by a fast, well-informed assistant, not a guarantee of accuracy.
5. Acceptable use
You agree not to use NextShot to:
- Send unsolicited bulk messages in violation of CAN-SPAM, CASL, GDPR, the UK PECR, or similar laws
- Contact anyone who has asked you, your organization, or NextShot not to contact them
- Disguise who you are, use misleading sender information, or write deceptive subject lines
- Contact people in their personal capacity (consumers) rather than in their professional role
- Harass, threaten, or discriminate against anyone
- Upload data you don’t have the right to use (e.g., contact lists obtained unlawfully)
- Sell, rent, or hand over contact information found through NextShot to anyone outside your organization
- Attempt to reverse-engineer, scrape, or overload the Service
- Use the Service to build a directly competing product
- Violate any applicable law or third party’s rights
6. Your outreach and the law
You are the sender of every message you send using NextShot, and you’re responsible for making sure your outreach complies with the laws that apply to it, including anti-spam, marketing, and privacy laws in the places your recipients are. That includes honoring opt-out requests promptly, having a lawful basis to contact each person, and getting prior consent where the law requires it (for example, cold email to businesses in Germany or Austria).
NextShot includes tools to help: a required footer with your business mailing address and, by default, an opt-out line on every email sent through the Service, a do-not-contact list that blocks writing to or sending to listed people, and warnings for countries with stricter rules. You agree to keep your mailing address accurate and to add anyone who asks to stop hearing from you to your do-not-contact list. These tools support compliance; they aren’t legal advice and don’t guarantee it.
Your account owner can turn the opt-out line off. If they do, they confirm that your company remains responsible for giving recipients a way to opt out wherever the law requires one, and NextShot records who turned it off and when. NextShot still includes the line on email to recipients in Canada, the European Union, the United Kingdom, and Switzerland.
7. Contact data found through NextShot
Some features help you find publicly available professional information about people at companies you target, such as names, job titles, work email addresses, and public profile links, using web search and third-party data providers. NextShot records where and when each contact was found so you can show where the information came from. You may use this information only to contact people about matters relevant to their professional role, and you’re responsible for how you use it.
If someone asks NextShot directly to stop processing their information, we may add them to a platform-wide do-not-contact list. Once that happens, nobody can use NextShot to write to them.
8. Subscriptions and billing
Paid plans are billed in advance on a monthly or annual basis through our payment processor, Stripe. Prices and included usage for each plan are listed at nextshotai.org/plans. Plans are priced per seat, and there is no free plan or free trial. Subscriptions renew automatically at the end of each billing period (each month, or each year on an annual plan) at the then-current price for your plan and seat count, until you cancel.
You can cancel at any time in Settings. Cancelling stops the next renewal: you keep access until the end of the period you’ve already paid for, and then it ends. Fees are non-refundable, including on annual plans: we don’t refund or credit unused time when you cancel partway through a month or year, except where the law requires it.
Adding seats during a period is charged right away, prorated for the time left in that period. Removing seats takes effect at your next renewal: you keep the seats until then, and the rest of the current period isn’t refunded or credited. Self-serve plans go up to 25 seats; larger teams are on Enterprise, invoiced under a separate agreement.
Each plan includes a monthly generation allowance and a set number of accounts per seat, as described on the Plans page; these are subject to change with notice. Generation packs and account packs are one-time purchases: they don’t renew, don’t expire, and are non-refundable. Customers billed by invoice agree to pay each invoice by its due date; access may be suspended if an invoice remains unpaid.
9. Third-party integrations
NextShot integrates with services you choose to connect, currently Gmail (for creating drafts, sending the messages you approve, reading your signatures, and tracking replies) and, optionally, your own Apollo account (for finding email addresses). Connecting an integration authorizes NextShot to access the specific scope of data needed for that feature, described at the time you connect it. You can disconnect an integration at any time in Settings.
10. Personal data processing
When NextShot processes personal data in your workspace on your behalf, we act as your service provider (a “processor” under the GDPR). If you need a Data Processing Addendum, for example because you contact people in the EU or UK, request one at legal@nextshotai.org.
11. Termination
You may stop using NextShot and cancel your subscription at any time. You can also delete your account in Settings: this cancels your subscription immediately, without a refund for the rest of the current period, and permanently erases your workspace data (export it first in Settings if you want a copy). A team owner must remove their teammates or transfer ownership before deleting their account. We may suspend or terminate access for violations of these Terms, non-payment, or conduct that risks harm to the Service or other users. If we terminate your access, we’ll provide a reasonable window to export your Customer Data before deletion, except where legal requirements prevent it.
12. Disclaimers and limitation of liability
The Service is provided “as is” without warranties of any kind, express or implied, including fitness for a particular purpose. To the maximum extent permitted by law, NextShot is not liable for indirect, incidental, or consequential damages, or for the outcome of outreach conducted using AI-generated content. Our total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim.
13. Indemnification
You agree to defend and indemnify NextShot against claims, fines, and costs arising from the messages you send using the Service, the data you upload, or your breach of these Terms or applicable law, except to the extent caused by NextShot’s own breach of these Terms.
14. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be brought in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.
15. Changes to these Terms
We may update these Terms from time to time. If a change is material, we’ll notify you by email or in-app notice before it takes effect. Continued use of the Service after a change takes effect means you accept the updated Terms.
